Requirements 12-39 32. Lead-Based Paint Change Date March 28, 2019 • This chapter has been revised in its entirety. a. Properties Built in 1978 or Later If the dwelling or related improvements were built in 1978 or later, the appraiser must report all defective paint surfaces on the exterior and require repair of any defective paint that exposes the subsurface to the elements. Interior defective paint on a dwelling built in 1978 or later is normally considered cosmetic. b. Properties Built Before 1978 If the dwelling or related improvements were built before 1978, the presence of lead-based paint must be presumed. Any defective lead-based paint is a safety hazard that must be remediated. The appraiser must clearly identify the location of any defective paint. Economic feasibility is not an acceptable reason for waiver of a repair involving lead-based paint. c. Correction of Defective Lead-Based Paint Any defective lead-based paint must receive adequate treatment to prevent the ingestion of contaminated paint. Either: • the surface requiring treatment must be thoroughly washed, scraped, wire brushed or otherwise cleaned to remove all cracking, scaling, peeling, chipping, and loose paint, and then repainted with two coats of a suitable nonleaded paint, or • the paint shall be completely removed or the surface covered with a suitable material such as gypsum wallboard, plywood, or plaster before any painting is undertaken if the integrity of the surface needing treatment cannot be maintained. d. Appraiser Certification of Repairs The completion of all repairs involving defective lead-based paint must be certified by the VA-assigned appraiser.

Describe exterior work to be performed, such as: removal of defective, buckled wood members; providing a structurally sound porch floor, properly finished; replacement of existing porch with masonry steps and stoops; providing ornamental iron or wood railing or parts; etc. Most estimates must be based on lineal or square footage projections. 7. Walks. Describe walk work to be performed, such as: installation of new concrete walks; installation of concrete steps at (____); etc. Most estimates must be based on square and lineal footage projections. 8. Driveways. Describe driveway work to be performed, such as: remove old driveway and apron; install blacktop asphalt drive (minimum two feet) over existing drive and apron; install new concrete driveway (minimum four feet) and apron with wire mesh; etc. Most estimates must be based on square and lineal footage projections. 9. Painting (Exterior). Describe exterior painting work to be performed, such as: scrape, sand smooth and paint a minimum of two coats of good quality paint on all exterior woodwork and metal; etc. Most estimates must be based on square and lineal footage projections. If the Property was built before 1978, a U.S. Environmental Protection Agency (EPA) or state-certified lead-safe renovation contractor must be used for the painting work; machine sanding and use of propane or gasoline torches (open flame methods) are not permitted, and just washing and repainting without thorough removal or covering with siding does not constitute adequate treatment. Required Work Items: All defective (cracking, scaling, chipping, peeling, loose, or flaking paint and paint that is to be disturbed by this Painting (Exterior) point or other points in the Work Write-Up must be scraped, primed and double coated. Because of the concern for lead paint ingestion, all peeling paint conditions must include scraping, priming and double coating of surface areas. If the Property was built before 1978, paint mitigation must be in compliance with EPA’s Renovation, Repair and Painting Rule and HUD’s lead-based paint regulations regarding paint mitigation at 24 CFR 200.810(c). Some states may require more specific treatment. 10. Caulking. Describe caulking to be performed, such as: caulk all windows and door frames; etc. Most estimates must be based on lineal footage or lump sum projections. # "Peeling Paint" Here's what we mean by peeling paint: it's paint that is cracking, scaling, chipping, loose, or flaking off a surface. If a house was built before 1978, we have to assume the paint contains lead, and peeling paint is a serious safety hazard that must be fixed—cost doesn't matter as an excuse. For pre-1978 homes, peeling paint has to be scraped down to bare surface, primed, and painted with at least two coats of non-lead paint, or the old paint must be completely removed and the surface covered with something like drywall or plywood. If the house was built in 1978 or later, we still require repair of peeling paint on the outside if it exposes the wood or material underneath to weather damage, but peeling paint inside is usually just a cosmetic issue we don't require fixed. HUD/FHA adds that if a pre-1978 property has peeling paint, a certified lead-safe contractor must do the work, and power sanding or open flames are not allowed.
