Agency–The Texas Real Estate Commission and the Texas Appraiser Licensing and Certification Board. Board–The Texas Appraiser Licensing and Certification Board. Chief Financial Officer–The Chief Financial Officer of the Texas Real Estate Commission. Commission–The Texas Real Estate Commission. Comptroller–The Comptroller of Public Accounts. DIR–The Department of Information Resources. Executive Director–The Executive Director of the Commission and the Board. TAC–The Texas Administrative Code. TFC–The Texas Facilities Commission. return to top §151.2 Charges for Copies of Public Information The Board adopts by reference the rules promulgated by the Commission regarding Charges for Copies of Public Information as set forth in 22 TAC §534.2. return to top §151.3 Employee Training and Education The Board may provide training and education for its employees in accordance with Subchapter C, Chapter 656, Texas Government Code. The Board may spend public funds as appropriate to pay the costs associated with employee training, including, but not limited to, salary, tuition and other fees, travel, and living expenses, training stipend, expense of training materials, and other necessary expenses of an instructor, student, or other participant in a training or education program. The Executive Director shall adopt policies related to training for Board employees, including eligibility and obligations assumed upon completion. Before an employee may receive reimbursement of tuition expenses for successful completion of a training or education program offered by an accredited institution of higher education, the Executive Director must pre-approve the program and authorize the tuition reimbursement payment. Approval to participate in any portion of the Board's training and education program does not affect an employee's at-will status. TEXAS APPRAISER LICENSING AND CERTIFICATION BOARD Sec. 1103.051. TEXAS APPRAISER LICENSING AND CERTIFICATION BOARD. The Texas Appraiser Licensing and Certification Board is an independent subdivision of the Texas Real Estate Commission. Added by Acts 2001, 77th Leg., ch. 1421, Sec. 2, eff. June 1, 2003. Sec. 1103.052. BOARD MEMBERSHIP. (a) The board consists of nine members as follows: (1) the executive secretary of the Veterans' Land Board or the executive secretary's designee; and (2) eight members appointed by the governor with the advice and consent of the senate as follows: (A) four members who are certified or licensed appraisers actively engaged in the practice of appraising real property; and (B) four public members who qualify for appointment based on their recognized business ability. If material deficiencies identified in the appraisal report are not corrected or addressed by the appraiser upon request, or if there is evidence of any unacceptable appraisal practices detailed in B4-1.1-04, Unacceptable Appraisal Practices, the lender must forward the appraisal report and summary of findings to the appropriate appraisal licensing agency or regulatory board. The lender must also report suspected overt violations of anti- discrimination laws to the proper local, state, or federal agency. In the event of these occurrences, the lender may obtain a second or subsequent appraisal report. Note: After a loan has closed, an ROV request is no longer allowed to be submitted by the borrower. Fannie Mae’s objectives in referring appraisal reports to state appraiser licensing or regulatory boards are to emphasize continuing efforts to maintain the quality of appraisals, to protect Fannie Mae’s interest, to improve the quality of mortgages delivered to Fannie Mae by identifying appraisers that have performed appraisals of a sufficiently poor quality as to impair the security interests, to help the industry enhance the quality of appraisals by identifying and referring appraisals that are not adequately supported or credible, and to help enforce professional standards.
